From the ISAIL Secretariat
The Indian Society of Artificial Intelligence and Law (ISAIL) is thrilled to announce the publication of IPLR-IG-003, a comprehensive Feedback Report on the Draft Digital Competition Bill, 2024 published and developed by Indic Pacific Legal Research under the leadership of Mr Abhivardhan, our Chairperson.
This pivotal document, submitted to the Ministry of Corporate Affairs, Government of India, represents a significant milestone in our ongoing efforts to shape the future of digital competition law in India.
This endeavour could not have been possible without the invaluable contributions of our Research Interns - Vaishnavi Singh, Shresh Narang, and Krati Bhadouriya. Their dedication and hard work have been instrumental in the preparation of this report.
Indic Pacific Legal Research has extended gratitude to the distinguished members of the ISAIL Advisory Council and Akash Manwani for their expert insights and unwavering support throughout this project.
The Feedback Report delves deep into the Draft Digital Competition Bill, 2024, offering a detailed analysis from Page 69 onwards.
It not only provides a thorough breakdown of the entire Committee on Digital Competition Law Report but also examines the Stakeholder Consultations, the Digital Personal Data Protection Act (DPDPA), Consumer Laws, and the key international practices that have influenced the current draft of the Bill.A preliminary review of the Bill reveals a strong influence from the Digital Markets Act of the European Union.
However, it is clear that the Bill introduces unique Indian perspectives to digital competition law, particularly evident in Sections 3, 4, 7, and 12-15.Furthermore, the report presents several recommendations, drawing on insights from aiact.in version 2, on how the application of artificial intelligence could potentially foster anti-competitive practices, especially concerning intellectual property and knowledge management.
